When is pool lift compliance required?
The Americans with Disabilities Act (ADA) is a civil rights law that prohibits discrimination on the basis of disability. Published in the Federal Register, September 15, 2010, and taking effect on March 15, 2011. Compliance is required by March 15, 2012
Swimming pool facilities required for compliance
- Title II facilities such as schools, municipalities, cities, counties and all public entities at the local and state levels
- Title III facilities such as private schools & universities, YMCA's, Boys & Girls Clubs, camps, health clubs, recreational facilities
- Any facility engaged in selling pool passes to the public is considered commercial facility
- Any facility open to the general public is considered a public facility
- Facilities intended for aquatic recreation use are required a permit for operation (public, semi-public, commercial, non-commercial, not-for-profit, etc).
Rules & Requirements

Primary access for all pools shall be a pool lift.
- Any pool under 300 linear feet of pool wall must provide one means of access and that means must be either a automated pool lift or sloped entry.
- Any pool over 300 linear feet must provide (2) two means of access, one means of access can be a pool lift. The second means of access for large pools can be any of the five designated means of access.
- Pool lifts, sloped entries, transfer walls, transfer systems or accessible pool stairs.
- Wave, action, lazy rivers and other pools where user entry is limited to one entry.
Financial Assistance - ADA Tax Credit
A special tax credit is available to help employers make accommodations required by the ADA. Information discussing the tax credits and deductions is contained in the Department of Justice's ADA Tax Incentive Packet for Businesses available from the ADA Information Line. Information about the tax credit and tax deduction can also be obtained from a local IRS office, or by contacting the Office of Chief Counsel, Internal Revenue Service
Lift Placement & Requirements
- Both stationary & portable lifts are compliant.
- Must have a solid seat & foot rests. Sling style lifts are no longer compliant.
- Manual rotating & hand-crank lift operation is no longer complainant.
- Lifts shall be capable of unassisted operation as well as being operated from the deck & water at all times.
- Single person lifts are required to have a minimum weight capacity of 300 pounds and be able to sustain a load at least one & a half times the rated load
- Lift seats must be a minimum of 16 inches in width.

Lift Seat Location: When the lift is raised, the seat must be located over the deck 16 inches from the edge of the pool.
- The seat must be able to submerge a minimum of 18 inches below water level.
- When lift is raised the seat must be between 16 and 19 inches above the pool deck.
- Lift location: Where multiple pool lift locations are provided, no more than one pool lift shall be required to be located in an area where the water level is 48 inches
- Lifts must not be located in water no deeper than 48 inches
- Clear Deck Space: On the side of the seat opposite the water, a clear deck space shall be provided parallel with the seat. The space shall be 36 inches wide minimum and shall
